Use of Poem.

I am starting a nature product line, and I would like to use
a poem by Joyce Kilmer on a T-Shirt.

How do I go about determining if this long-dead and brilliant poet had an estate?
I also need to learn about fair use of all sorts of artistic works, what's in the public domain and what is not.
