is a commerical real estate contract in fl. legal to pay a commission if no listining contract was offered nor signed by either sellers or buyer.

a broker[buyer] offered a 184-k offer, we accepted 100-k dn. taking back a 2nd. for the 84-k.the contract did not state the 84-2nd. but they gave me an addendum to the contract. now the next day they came back w/2nd. contract of 110-k we accepted with the 84-k addendum. they said they needed a 10-k commission to fix up the property.the bank loaned on a 114-k cert. appraisal with 88-kfinannced by bank with fed. secured funfs, buyer put the balance of 110-k at closing and walked out w/ a 10-k commission from the proceeds.the bank did not know of the 84-k 2nd. broker said we would sign on the 2nd. outside of closing and the bank. dont need to know anything about it.what is my legal position here, can I file complaiant to the board of RE,sue for the 10-k, or what...NO LISTING CONTRACT HERE...
