First thing is first, you need to protect yourself from legal action. Form an LLC (limited liability company).
Next, if you have created a new product you need to protect your product, possibly with a patent.
What kind of business are you starting? Can you comment with more information?

If you're structuring your company as a sole proprietorship or a partnership, you have the option of choosing a business name, or dba ("doing business as"), for your business, known as a fictitious business name.
You'll likely also need to file your fictitious name with the state.

Hello there! Are you planning to start your own business from scratch or to become a representative for a direct sales company?
As far as being legal with the former, the other posters have given you great advice.
With the latter, you should be covered legally with the company. What you need to do for that is save all your receipts and make sure that your homeowner's or renter's insurance covers any products or promotional materials you have.
